An analysis of available empirical evidence regarding exclusion of the CIGS in practice reveals the various factors which appear to influence lawyer choices to exclude the CISG. Then, through the prisms of behavioural economics, psychology, game theory, group dynamics, and institutional behaviour, the author identifies the factors that influence the frequency of use of the CISG in practice, and critiques the normative underpinning of the CISG to test whether it is indeed presently an efficient law, what factors affect its efficiency, and whether its efficiency can be improved."

8 "Proof of causation in tort law / Sandy Steel","New York : Cambridge University Press, 2015" Causation is a foundational concept in tort law: in claims for compensation, a claimant must demonstrate that the defendant was a cause of the injury suffered in order for compensation to be awarded. Proof of Causation in Tort Law provides a critical, comparative and theoretical analysis of the general proof rules of causation underlying the tort laws of England, Germany and France, as well as the exceptional departures from these rules which each system has made. Exploring the different approaches to uncertainty over causation in tort law, Sandy Steel defends the justifiability of some of these exceptions, and categorises and examines the kinds of exceptional rules suggested by the case law and literature. Critically engaged with both the theoretical literature and current legal doctrine, this book will be of interest to private law scholars, judges and legal practitioners.
9 "The business and human rights landscape : moving forward, looking back / edited by Jena Martin, West Virginia University College of Law, Karen E. Bravo, Indiana University School of Law","New York : Cambridge University Press, 2016" The adoption of the United Nations Guiding Principles on Business and Human Rights in 2011 marked a watershed moment, establishing the first global standards for preventing human rights abuses by business. In light of this paradigm shift, The Business and Human Rights Landscape offers the most comprehensive analysis to date of the current legal framework. Its essential research tools include in-depth explorations of the UN Guiding Principles from both theoretical and practical standpoints, with case studies of the Rana Plaza building collapse and Kenyan resource extraction. Bookending current analyses are accounts of business and human rights from a historical perspective (discussing the colonial slave trade) and using a forward-looking lens (analyzing labor's role). Bringing together scholars from across the globe, this book represents essential reading for anyone interested in the past, present, or future of business and human rights.
